2.0 General
These General Conditions shall apply to all Rarity4u contracts of sale. The placing of an order for goods and or services shall be deemed to be acceptance of these General Conditions. Deviations from these General Conditions shall not apply unless agreed to in writing.
 
3.0 Electronic Communications
When you visit the website www.rarity4u.com or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. It is understood that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
 
4.0 Orders
Only written electronic orders by e-mail are binding on Rarity4u.
 
A written electronic order confirmation will be sent to the buyer by e-mail within 7 days of the receipt of the order.
 
5.0 Delivery
Rarity4u ship worldwide using reputable and efficient international companies similar but not limited to the following: Postal System, DHL, UPS, FedEx.
 
Shipping charges are calculated according to the total weight or volume of the order and the buyer meets all shipping charges. The risk of loss and transfer of property rights and title of goods are transferred to the buyer upon delivery to the carrier.
 
Shipping charges are the responsibility of the buyer and orders are despatched as soon as possible after the full payment has been cleared at our bank.
 
6.0 Conformity Of Delivery
It is understood that unless the buyer notifies the seller within 7 days after receipt of the goods, that the delivery conforms to the terms of the order.
 
7.0 Import & Export License
Any required license, or any import or export requirements or limitations are the responsibility of the buyer. Any delays related to the failure to obtain a license or to import into a country shall not constitute a basis for rescission or cancellation of a purchase.
 
8.0 Local Charges And Tax
Any local charges or taxes in the destination country are the responsibility of the buyer.
 
9.0 Authenticity And Condition
We aim to provide a professional service and each item has been selected, authenticated and carefully inspected for condition. A fair and professional judgement is made about each item being in good, excellent, perfect or mint condition. Nothing less is offered for sale on this website. If any restoration, wear or damage is present, it is accurately reported in the item description. We attempt to describe the item as accurately as possible and try to avoid misleading information by understating rather than overstating the item description. Further detailed photographs of the item in which you are interested can be made available on request. All purchases are fully guaranteed.
 
Poor Condition
This means a lot of visible wear, dents, chips and poor surface condition are in evidence.
The assumption being the item has been used extensively and has suffered from lack of care.
 
Acceptable Condition
This means small traces of wear and small dents are possible.
The assumption being, the item has been used daily
 
Good Condition
This means some blemishes visible when looking closely and some signs of wear commensurate with the age of the item.
The assumption being, the item has been used considerably.
 
Silver & Gold plated pieces may have worn spots on foot, stem or base and may have a dull patina. Scratches are common.
 
Stainless Steel may have scratches and wear marks typical of a piece that was used daily. The piece may be used as an average replacement piece.
 
Very Good Condition
This means almost no blemishes and little signs of wear. Some very light scratching may be in evidence and older pieces may have some spots.

Excellent Condition
This means no blemishes and works perfectly with no visible wear. And shows very few signs of being used.
The assumption being, the item is almost in the as new condition.
 
Perfect Condition
This means no blemishes, works perfectly and has no signs of wear.
The assumption being, the item has hardly been used.
 
Mint Condition
This means unused, not used only a small amount.
The assumption being, the item has not been used.
 
10.0 Refund
For all items purchased online from Rarity4u the following conditions apply:
 
We agree to cancel any sale and return all proceeds to the buyer, for a period of seven working days from the date the parcel is received by the buyer, when it is reasonably demonstrated that the physical condition of the item is not as described in the information given either in the e-store, through email or during the auction and provided the goods are received by Rarity4u in their original condition. Any alterations, resizing, engraving, damaged, broken, polished or similar to the item will invalidate the guarantee.
 
In order to receive the refund, the buyer must return the item to us in the same manner in which it was received to include but not limited to the following:
 
  • Packaged in Rarity4u package or better
  • Insured at the buyer's cost
  • Sent by the same carrier at the buyer's cost
  • Using the same export harmonized code that was originally used by Rariy4u.
Any customs or import duties and fees, whether assessed by any governmental authority or other person or entity, are not included in the total purchase price, and will therefore not be refunded.
 
These foregoing rights of rescission are only available to the original buyer and may not be assigned to, or relied upon, by any subsequent transferee of the property sold

12.0 Payment
Unless otherwise agreed in writing, the purchase price including shipping charges shall be paid in full before the goods are prepared ready for shipping. All orders are subject to bank clearance and the items remain the property of Rarity4u until bank clearance has taken place.
 
If the Buyer fails to pay by the agreed date, the Seller shall be entitled to use whatever steps are necessary to extract payment.
 
If the Buyer has not paid the full amount within 14 days, the Seller shall be entitled to terminate the contract by written notice to the Buyer and claim compensation for the loss he has suffered. The compensation shall not exceed the agreed price.
 
We accept a number of different payment methods in several different currencies. The current pay methods and currencies accepted are as shown on our website.
 
We cannot reserve any item without payment being received and confirmed.
 
13.0 Reservation of Title
The goods remain the property of Rarity4u until paid for in full to the extent that such retention of property is permitted by the applicable law.
 
14.0 Time for Delivery, Delay
If the Seller finds that he will not be able to deliver the goods at the agreed time for delivery, or if delay on his part seems likely, he shall forthwith notify the Buyer in writing, stating the reason for delay and if possible the time when delivery can be expected.
 
If delay in delivery is caused by a circumstance which under Clause 15.0 (Force Majeure) shall be considered a case of relief or by an act or omission on the part of the Buyer, the time of delivery shall be extended by a period that is reasonable having regard to the circumstances of the cause. The time for delivery shall be extended even if the reason for delay occurs after the originally agreed time for delivery.
 
15.0 Grounds for Relief (Force Majeure)
The following circumstances shall be considered as grounds for relief if they impede the performance of the contract or makes performance unreasonably onerous: industrial disputes and any other circumstances beyond the control of the parties such as fire, war, mobilisation or military call up of a comparable scope, requisition, seizure, currency restrictions, insurrection and civil commotion, shortage of transport, restrictions in the use of power.
 
The above described circumstances shall constitute grounds for relief only if their effects on performance of the contract could not be foreseen at the time of formation of the contract.
 
The party wishing to claim relief shall notify the other party in writing without delay on the intervention and on the cessation of such circumstances.
 
16.0 Liquidated Damages
Rarity4u are not liable for any claims in excess of the sales value of the item purchased. This includes any liability for products not being available for use. Rarity4u will not be liable for loss of profits, loss of business or other consequential, special, indirect or punitive damages, even if advised of the possibility of such damages, or for any claims by any third party except as expressly provided herein. Our sole liability of any claims, whether based in contract or tort, at law or in equity, for any loss or damages arising, resulting from, or connected with the products, and this agreement shall be limited to the lesser of the actual amount of such loss or damages or the purchase price paid by the customer, for the products that are the subject of the claim.
 
17.0 Disputes, Applicable Law
Disputes arising out of or in connection with the contract shall not be brought before the court, but shall be finally settled by arbitration in accordance with the law on arbitration applicable in the Seller’s country.
 
All disputes arising out of the contract shall be judged according to the law of the state of Norway.
